HR departments are cutting back on compliance following the introduction of tribunal fees while trade unions are becoming stronger and more militant, an employment lawyer has warned.
Speaking at Pensions and Benefits UK, Outer Temple Chambers employment barrister Daniel Barnett also noted that the government's review of tribunal fees gave the aura that it might be pre-determined.
"HR departments, business owners, particularly small business owners, know that the chances of being sued are that much less so there is an attitude now of, ‘We had to jump through these hoops before, let's take a risk'," he said.
"There's a boost in union membership and a shift towards almost militantism because the unions, which have fallen off in power in the last few years, partly because people had the right to their own method of redress in the tribunal.
"Unions are now finding people are joining again and rather than going to tribunal, which unions don't want to fund, are now increasingly becoming militant.
"They are increasingly flexing their muscles and saying ‘let's do work to rule, let's do some minor industrial action'," he added.
